Outlaw Mask Mandates in West Virginia (and everywhere else)


There are two anti-mask bills currently in the West Virginia House. HB 4071 and HB 4031. Both have merit. However, if strengthened as suggested below, HB 4031 could potentially end all mask mandates in West Virginia, which are essentially the legal equivalent of attempted suffocation.


If you live in West Virginia, please copy the letter below and email your representatives. Be sure to paste with formatting to capture the embedded links. And don't forget to add your name.


It is also productive to email at least the chairs and vice chairs of both the Health and Human Resources Committee and the Judicial Committee. I've spoke to several delegates already, and they are very receptive to hearing your voice and moving these bills across the finish line. Dear Senators and Delegates,


I strongly urge you to vote yes on HB 4071 and HB 4031.


However, HB 4031, if strengthened can potentially end all mask mandates in our state. Below are specific recommendations to strengthen this HB 4031, which I implore you to work with both the Health and Human Resources and Judicial committees to incorporate.


Recommendations.


I. Recommend changing the verbiage in HR 4031 as follows:


ARTICLE 2. FACE MASKS MANDATES PROHIBITED


§ 16-2-18. Prohibition on face coverings and mask mandates.


(a) The State of West Virginia, any agency of any branch of government thereof, any local health board, any state manager at any level, any federal agency, and any employer, be they federal, state, or private, are heretofore prohibited from implementing any mandatory face covering in response to the COVID-19 pandemic or otherwise. The requirements of §61-6-22 of this Code relating to the wearing of masks hoods, or face coverings shall still apply.


(b) Any person who violates this section is guilty of the felony of attempted suffocation without consent, as defined in §61-2-9d(a), and upon conviction thereof, shall be fined not more than $2,500 or imprisoned in a state correctional facility not less than one year or more than five years, or both fined and imprisoned.


II. Recommend adding the following modification to §61-6-22(b)(3):


§61-6-22(b)(3) Engaged in a trade or employment where a mask, hood, or device is worn for the purpose to ensuring the physical safety of the wearer, such as protecting the individual’s face from projectiles, macro particulates, e.g. saw dust, heat, industrial chemicals, etc., or limited surgical/medical environs at the discretion of the attending physician or attending medically trained personnel; this exclusion is not intended to allow any government, medical, or public health official, employer, or person carte banc allowance to mandate masks, hoods, or devices in attempt to control airborne respiratory illnesses such as COVID-19, influenza, the common cold, etc., and such actions are prohibited in accordance with §16-2-18;


DISCUSSION.


As currently written HR 4031 falls woefully short of entirely prohibiting mask mandates in the state. It leaves open room for mandates by private employers, local managers of various state agencies, and various branches of the federal government with offices within the state, which employ West Virginia Citizens.


Your overriding job as representatives is to protect the rights of individual citizens of the state of West Virginia. Principle among these rights are the right of bodily integrity, the right of informed consent, and the right to breath unrestricted, as humans have done so for eons. The COVID-19 scamdemic has seen, as described so aptly by Dr. Joseph Mercola, a Biopolitical War on Breathing develop to the point where people are now deathly afraid of their fellow human, by virtue of their very existence, be they friend, family, colleague, or mere passer-by. Such a state of affairs is detrimental to both the short- and long-term health of individuals, families, communities, corporations, state and federal agencies, and society in general.


Aside from a properly fitted N95 mask, which only protects the wearer, not those around him, the practice of masking does little to prevent viral transmission. In fact, there are numerous health risks to the wearer. These risks include:


1. Hypoxia (decreased blood O2)

2. Hypercapnia (increased blood CO2)

a. Both conditions markedly decrease brain function, i.e. cognitive capability

b. Both conditions markedly decrease immune system response

3. Hypercapnia leads to an increase in the fear response

4. Mask Induced Exhaustion Syndrome (MIES)

5. Headaches

6. Increased oral cavity toxicity

a. Masks retain bacteria, parasites, and fungi, including pathogenic and pneumonia-causing bacteria

7. Skin irritation

8. Retarded brain development among children and adolescents

a. From both hypoxia and hypercapnia

9. Retarded fetal development

10. Infants’ and young children’s cognitive development are retarded due to the inability to learn to see, and therefore read, adult human facial expression

11. Impaired communication between individuals

a. Auditorily

b. Visually


The article, #takethemask off, summarizes these, with several dozen references, including several graphic video illustrations. However, the most exhaustive reference is a meta study from April 20, 2021, in which the closing paragraph reads:

The described mask-related changes in respiratory physiology can have an adverse effect on the wearer’s blood gases sub-clinically and in some cases also clinically manifest and, therefore, have a negative effect on the basis of all aerobic life, external and internal respiration, with an influence on a wide variety of organ systems and metabolic process with physical, psychological and social consequences for the individual human being.

The legal definition of “suffocate,” in accordance with §61-2-9d(a), is:

“Suffocate” means knowingly and willingly restricting the normal breathing or circulation of blood by blocking the nose or mouth of another,

Those mandating mask wearing think that they are somehow protecting those with whom they might have some level of responsibility, yet they are all too often ill-informed of the real hazards and consequences of their decisions. In mandating a mask wearing, they are attempting to “knowingly and willingly restrict the normal breathing or circulation of blood by blocking the nose or mouth of another,” without the other’s consent §61-2-9d(b). They are, in fact trying, to suffocate others.


The language I suggest above strengthens HB 4031, while clarifying and limiting §61-6-22(b)(3). Call a spade a spade – mandating a mask is no less than attempted suffocation, and those guilty of such should be held appropriately accountable. The language is also consistent with both the Ninth and Tenth Amendments to the U.S. Constitution.


Make no doubt about it, gentlemen, Anthony Fauci, and the unnamed bureaucrats at the CDC know exactly what they are doing with their continued vacillations about masking and COVIDVax mandates and recommendations. They are all extremely intelligent, but they are also malevolent, manipulative, and tyrannically inclined. However, as I point out elsewhere, it is all those would-be little tyrants, who knowingly or unknowingly, and often with otherwise benign “good intentions,” who enable and facilitate the actual power hungry, psychopathic tyrants.


There is an old saying, “The road to hell is paved with good intentions.” Ladies and gentlemen, we’ve been in the slow lane of that road for the better part of the last century, but we jumped into the accelerated express lane in March 2020. It is time to pull over and stop, and it is far, far past time to end the lies, obfuscations, and stupidity that have consumed the country for the last two years.


Let West Virginia take the lead in eliminating the mask mandates. Incorporating the language above will not only protect the rights of individuals to have bodily integrity, consent without harassment or coercion, and to breath as both God and Nature intended, it will also start to heal the psychological health of our communities. Finally doing so, and getting that bill passed, and signed into law, will send a powerful message to other states that West Virginia lives up to its motto, “Montani Semper Liberi,” and is truly a leader in freedom, health, and truth.

Beating this COVID insanity at the local level is the only way we are going to get out of this. The feds are gone, and only by asserting our rights under the 9th and 10th amendments, as well as civil non-compliance, will we start to roll back their overreach.


Please pass this around to others and have them do the same. The more the representatives understand how fed up people are, the more they will be inclined to actually pay attention and do our bidding, for if the don't, we WILL get rid of them from office, one way or another, and get someone in who will. The representative on the Judiciary Committee, with whom I spoke with today, was very encouraged to hear from folks in the state and is extremely supportive of these bills. Let's get this done!


If you live in another state, please investigate what bills are being considered in your state and brow beat your representatives. By all means, please, please, please, adapate the letter above to your own state's situation. I'm will to bet that most states have similar verbiage in the statues above suffocation and you will be able to make a similar argument.

The proposal still doesn't ban forced masking of guests/patrons/customers at businesses...
